Welcome to the website of Patisserie and Other Ltd.
These General Terms and Conditions (hereinafter referred to as the GTC) contain the following. www.csokbudapest.hu website (hereinafter referred to as the "Website"), the terms and conditions of use of the service available on the Website by the user (hereinafter referred to as the "Customer").
If you wish to become a customer or an active user of the Website, please read carefully our General Terms and Conditions (hereinafter: GTC) and only use our services (order, subscription, purchase) if you agree with all of its points and consider them binding for you.
In case of any questions regarding the operation of the Website, ordering and delivery process, we are at your disposal at the contact details provided on the Website.
Please note that these GTCs may set out different conditions for natural persons acting outside their profession, self-employed occupation or business activity (hereinafter referred to as "Consumer") as a Buyer in certain points compared to the provisions that also apply to businesses. In this case, the Consumer shall be subject to the different rules.
The technical information necessary for the use of the Website, which is not included in these GTC, is provided in other information available on the Website.
The language of the contract is Hungarian.
The service is only available in Budapest.
The order placed on the Website is not in writing, but is a declaration of rights made by way of an implied act, so the contract concluded electronically between the Customer and Csók Bisztró Gastronomy Ltd. is not a written contract, it is not filed by Csók Bisztró, so it is not accessible and cannot be viewed afterwards.
Orders can only be placed electronically via the Website. It is not possible to place an order by phone, e-mail or letter, and Bistro Csók cannot fulfil orders received in this way.
By using the Website, the Customer acknowledges and accepts the provisions of these GTC.

1. CONDITIONS OF USE

The Customer may use the Website exclusively at his/her own risk and accepts that Csók Bistro shall not be liable for any material or non-material damage arising from the use of the Website, in addition to liability for breach of contract caused intentionally, by gross negligence or by criminal offence, or for damage to life, limb or health.
Kiss Bistro excludes all liability for the conduct of the users of the Website and the Customer is fully and solely responsible for its own conduct.
The Customer must ensure that the use of the website does not infringe the rights of third parties or the law, either directly or indirectly.
In the event of a violation, the Customer is fully and solely responsible for his/her own conduct, in which case Csók Bistro will fully cooperate with the competent authorities in order to investigate the violations.
Csók Bistro has the right, but not the obligation, to monitor any content (e.g. comments) that Users may make available through the use of the Website, and Csók Bistro has the right, but not the obligation, to look for signs of illegal activity in the content posted and shall not be liable for such content.
The pages of the service may contain links to the pages of other service providers. Csók Bistro accepts no responsibility for the privacy practices of these service providers or the activities of other third parties.
Due to the global nature of the Internet, the Customer agrees that when using the Website, he/she shall act in compliance with the provisions of the applicable national laws. If any activity related to the use of the Website is not permitted under the laws of the Customer's country, the User shall be solely responsible for such use.
If the Customer notices any objectionable content on the Website, he/she is obliged to report it to our company without delay. If our company, in the course of its good faith procedures, finds the report to be justified, it shall be entitled to delete the information or amend it without delay
1. SHOPPING ON THE WEBSITE
- REGISTRATION
The content of the Site is available to any Customer without registration, but registration will store shipping and billing information to facilitate future purchases.
In the registration interface, the Customer is required to provide the following information to our company:
- E-mail address
- Password
- Name
- Phone number
- Delivery address
Billing data, such as
- Name
- Billing address: city, postcode, street, house number, country
- If you are buying on behalf of a company, a sole trader or a private individual with a VAT number, please indicate the tax number when requesting a VAT invoice.From 1 July 2020, all invoices issued to taxable persons with a domestic tax number containing VAT passed on, regardless of the taxable amount, must indicate the tax number of the recipient of the invoice, regardless of the VAT amount passed on. In the absence of a tax number, the invoice cannot be issued.
On the Website, you have the option to set different billing and shipping addresses by default. If the billing and shipping addresses are not the same, the Customer has the option to enter the billing address by clicking on the appropriate checkbox.
Csók Bistro shall not be liable for any delivery delays or other problems or errors caused by the Customer's incorrect and/or inaccurate information. Our company shall not be liable for any damages resulting from the Customer forgetting his/her password or from it becoming available to unauthorized persons for any reason not attributable to Csók Bistro. Kiss Bistro treats each registration as a single individual.
By submitting the registration, the Customer accepts these GTC and the Privacy Policy. Our company will inform the Customer of the success of the registration by e-mail, in which the Customer can review the data provided during the registration process via a summary interface.
After successful registration, the Customer can log in to the Website by entering his/her login details (e-mail address, password) under the "Login" menu item.
Customer has the right to request the cancellation of his/her registration by info@csokbudapest.hu by sending a message to the following e-mail address. Upon receipt of the message, Bistro Csók will take care of the cancellation of the registration as set out in the Privacy Policy. The customer's user data will be removed from the system immediately after the cancellation; however, this will not affect the retention of data and documents related to orders already placed, nor will it result in the deletion of these data. Once removed, the data can no longer be restored.
The Customer is solely responsible for keeping the user access data (in particular the password) confidential. If the Customer becomes aware that his/her password provided during registration has been accessed by an unauthorised third party, he/she shall immediately change his/her password, and if it is suspected that the third party is misusing the password in any way, he/she shall notify Kiss Bistro at the same time.
The Customer undertakes to update the personal data provided during registration as necessary to ensure that they are up-to-date, complete and accurate.
1. ORDER / PURCHASE PROCEDURE
Information about products:
- There may be small differences between the characteristics (e.g. size, design and decoration) shown in the photos on the website and the actual product (e.g. seasonal fruit in the case of cakes), for which Bistro Kiss is not responsible.
- Bistro Csók expressly informs the Customer that dishes made from fruit and nuts may contain traces of seeds and shells. The Seller shall not be liable for any damage resulting therefrom.
- The Seller further informs the Customer that our products may contain traces of gluten, soy, milk, oil seeds and sugar!
No registration is required to purchase.
Select the products and add them to your basket.
Check the Cart (top right corner), then select a delivery or pick-up day and time slot. If necessary, you can leave us a request and message about your order here.
Confirm the time by pressing the appropriate button, then click To order button.
Enter your e-mail address, delivery address and telephone number.
This is particularly important as our colleagues may ask you to confirm your order over the phone. In case of delivery, we can reach you on this number if our courier gets stuck and/or cannot find the address.
Go to the delivery method button to select the appropriate delivery method.
Delivery times may vary depending on the delivery address.
During the purchase process, you may at any time modify or correct any errors or mistakes in the electronic recording of your data (type of product, quantity, personal data, delivery address, etc.).
Finally, check the information you have entered and click Go to payment methods button.
Here you can choose from three options. Payment by credit card through the secure Barion system, cash and/or credit card on receipt.
Sending the order button to finalise your order!
Your order summary and order number will then appear on your screen.
At the bottom of the page To order button, the Customer can send the final order. The Service Provider will send a confirmation of the success of the order to the Customer, including the Customer's order number.
So placing an order is the To order button, which creates a payment obligation for the Customer.
Conclusion of the contract, binding nature of the offer, confirmation:
The contract can be concluded in Hungarian. The placing of the order shall be deemed to be a contract concluded by electronic means, which shall be governed by the provisions of Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The contract is subject to the provisions of the Government Decree 45/2014 (26.II.26.) on the detailed rules of contracts between consumers and businesses and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.
The Customer will receive an automatic confirmation e-mail within 1 hour of the receipt of the order to the e-mail address provided, by which Csók Bistro accepts the Customer's offer, upon receipt of which the contract between the Parties is legally concluded. After receipt of the order - if necessary - our company will contact the User by phone to clarify the order and to agree on the details. The confirmation e-mail will contain the data provided during the order, the order details, the price of the products ordered, the payment and delivery methods, the serial number of the order, as well as any additional comments made by the Customer in relation to the order.
NUMBER:
Bistro Csók will issue a NAV receipt to the Customer after payment of the value of the purchase.

FIZETÉS:
Online credit card payments are made through the Barion system. Credit card details are not passed to the merchant. The service provider Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, licence number H-EN-I-1064/2013.

PERSONAL DELIVERY:
The packages can be collected in person between 12-20 pm at the Csók Bistro Café, Budapest, Andrássy út 112, 1062.
Upon receipt of the product, the Customer must check that the package is undamaged. If there is damage to the packaging, the Customer may ask the courier to return the package.
If the packaging is visibly damaged upon receipt and the damage occurred before the goods were received, Csók Bistro will provide the return or replacement of the product free of charge. Csók Bistro is not liable for any damage discovered after receipt!
Our Company shall not be liable if the Customer is not at the specified delivery address at the time agreed and indicated in advance and the delivery of the parcel fails.
Upon receipt of the product, the Customer must verify without delay that the quality and quantity of the product are appropriate.
RIGHT OF WITHDRAWAL AND RIGHT OF TERMINATION

How and under what conditions to cancel the order
You may change or cancel your order (including the method and time of delivery) until 16.00 on the day before the pick-up/delivery date indicated in the order. To cancel, please send an e-mail to info@csokbudapest.hu to the following e-mail address. Please quote the order number in the confirmation e-mail as a reference.
If the purchase price is paid at the same time as the order is placed, we will reimburse you the purchase price less any bank transaction fees incurred in the event of a proper cancellation.
Tools provided to identify and correct data entry errors prior to order dispatch:
A Cart content can be checked, changed or even deleted at any time before the order is sent, and personal data can be changed at any time.
1. WARRANTY, GUARANTEE
Problems, complaints, complaint handling:
The Customer may report any problems or complaints related to the performance of the order to the following customer service contact details: by e-mail: info@csokbudapest.hu
- The Customer shall be responsible for the proper cooling and storage of the confectionery product after receipt.
- When stored refrigerated (+4°C), the confectionery products are safe for 36, 48 or 72 hours after receipt, and contain no added preservatives. For packaged products, please refer to the packaging for the shelf life).
- If a quality complaint against a Product relates to an unobvious characteristic of the Product, you may report your quality complaint to Kiss Bistro no later than 24 hours after receipt of the Product.
1. ENFORCEMENT OPTIONS
- Where, when and how to lodge a complaint:
The Customer may submit any consumer complaints regarding the product or the activities of Csók Bistro using the contact details provided;
Csók Bistro will, where it has the opportunity to do so, remedy the verbal complaint immediately. If it is not possible to remedy the oral complaint immediately, due to the nature of the complaint, or if the Customer does not agree with the handling of the complaint, the Bistro of Kiss Bistro shall keep a record of the complaint, which shall be kept for five years, together with the substantive response to the complaint.
Csók Bistro shall provide a copy of the report (on the premises) to the Customer on the spot in case of a verbal complaint made in person, or if this is not possible, it shall proceed according to the rules for written complaints detailed below.
Our company shall also prepare a record in the event of a verbal complaint communicated by telephone or other electronic communications service, and shall send a copy of the record to the User no later than the time of the substantive reply.
In all other cases, Csók Bistro will follow the rules for written complaints.
Complaints recorded by telephone or other means of communication will be given a unique identifier, which will make it easier to retrieve the complaint later.
We will respond to your written complaint within 30 days. Action under this contract means posting.
In case of rejection of the complaint, the Kiss Bistro will inform the User of the reason for the rejection.
Other enforcement options:
If any consumer disputes between us and the Customer are not resolved in the course of negotiations, the Customer has the following enforcement options
a./ Complaint to the consumer protection authority
If the Consumer detects a violation of his/her consumer rights, the Consumer may lodge a complaint in the first instance with the competent district office. Once the complaint has been examined, the authority will decide whether to initiate consumer protection proceedings.

In the event of a consumer dispute related to an online sales contract, consumers can settle their disputes related to online purchases, including cross-border disputes, electronically by submitting an electronic complaint through the online platform available via the link above.
To do this, the consumer simply registers on the online platform available at the link above, fills in a complete application and submits it electronically to the conciliation body via the platform. This makes it easy for consumers to enforce their rights, despite the distances involved.

If Csók Bistro rejects the Customer's complaint, the Customer is also entitled to apply to the Conciliation Board of the place of residence or stay: the initiation of the conciliation procedure is subject to the Customer attempting to settle the dispute directly with Csók Bistro.
The conciliation body is responsible for settling consumer disputes out of court. The conciliation body's task is to try to reach an agreement between the Kiss Bistro and the Customer with a view to settling the consumer dispute.
The conciliation body's proceedings are initiated at the request of the consumer. The request must be made in writing to the chairman of the conciliation body.

Csók Bistro has a duty of cooperation in the conciliation procedure.
For the purposes of the rules on the Conciliation Board, a consumer is also a non-governmental organisation, a church, a condominium, a housing association, a micro, small or medium-sized enterprise, as defined in a separate Act, who buys, orders, receives, uses, makes use of goods or is the recipient of commercial communications or offers relating to goods.
d./ Initiation of legal proceedings.
The Customer is entitled to enforce his/her claim arising from the consumer dispute before the court in civil proceedings in accordance with the provisions of Act V of 2013 on the Civil Code and Act CXXX of 2016 on the new Code of Civil Procedure.
1. TECHNICAL LIMITATIONS
Purchasing on the Website implies the Customer's knowledge and acceptance of the possibilities and limitations of the Internet, in particular with regard to technical performance and errors that may occur. Csók Bistro shall not be held liable in the event of any malfunction of the Internet network that prevents the operation of the Site and the purchase
1. UNILATERAL AMENDMENT OF THE ACEF
Csók Bistro may modify these GTC, the prices of the products sold on the Website and other prices displayed on the Website at any time with non-retroactive effect, such modification shall take effect after publication on the Website and shall apply only to transactions after the date of entry into force.
1. INVALIDITY OF THE PROVISIONS OF THE ACEF
If any provision of these GTC is held to be invalid, this shall not affect the validity of the contract concluded under these GTC and the other provisions of the contract shall remain in force. The remaining provisions of the contract shall be interpreted in a manner that best reflects the original intentions of the Kiss Bistro and the Customer.
Contracts concluded on the basis of these GTC shall not include any custom or practice established in the previous business relationship between Bistro Kiss and the Customer. Furthermore, contracts concluded on the basis of these GTC shall not include any custom or practice widely known and regularly used by the parties to a contract of a similar nature in the relevant business sector. The present GTC and the information and other information available on the Website constitute the entire content of the contract between Kiss Bistro and the Customer.
