This privacy notice contains the following information Patisserie and Other Ltd. (1117 Budapest, Baranyai utca 7. 3 doors, Tax number: 32241457-2-43, company registration number: 01-09-413730) (hereinafter referred to as the "Data Controller") uses and protects the personal data of its guests or prospective guests and business partners in what way and for what purpose.
The following information is provided pursuant to REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (General Data Protection Regulation).
From Patisserie and Other Ltd.. requests and processes personal data from guests, prospective guests and business partners in the course of its business activities, therefore this Privacy Policy is intended to provide information on the https://csokbudapest.hu/ website and the processing of data recorded by Csókbudapest as a data source.

FOGALOME DEFINITIONS
- "personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
- "processing" means any operation or set of operations which is performed upon personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
- 'controller' means a natural or legal person, public authority, agency or any other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of the processing are determined by Union or Member State law, the controller or specific criteria for the designation of the controller may also be determined by Union or Member State law;
- "processor" means a natural or legal person, public authority, agency or any other body which processes personal data on behalf of the controller;
- "recipient" means a natural or legal person, public authority, agency or any other body to whom or with which personal data is disclosed, whether or not a third party. Public authorities which may have access to personal data in the context of an individual investigation in accordance with Union or Member State law are not recipients; the processing of those data by those public authorities must comply with the applicable data protection rules in accordance with the purposes of the processing;
- "the data subject's consent" means a freely given, specific, informed and unambiguous indication of his or her wishes by which the data subject signifies, by a statement or by an act expressing his or her unambiguous consent, that he or she signifies his or her agreement to the processing of personal data concerning him or her;
- "data breach" means a breach of security that results in the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.
A PRINCIPLES GOVERNING THE PROCESSING OF PERSONAL DATA
Personal data:
- (a) be processed lawfully and fairly and in a transparent manner for the data subject ("lawfulness, fairness and transparency");
- (b) be collected only for specified, explicit and legitimate purposes and not processed in a way incompatible with those purposes; further processing for archiving purposes in the public interest, scientific and historical research purposes or statistical purposes shall not be considered incompatible with the original purpose in accordance with Article 89(1) ('purpose limitation');
- (c) be adequate, relevant and limited to what is necessary for the purposes for which the data are processed ("data minimisation");
- (d) be accurate and, where necessary, kept up to date; all reasonable steps must be taken to ensure that personal data which are inaccurate for the purposes of the processing are erased or rectified without undue delay ("accuracy");
- (e) be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be kept for longer periods only if the personal data will be processed for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1), subject to the implementation of appropriate technical and organisational measures as provided for in this Regulation to safeguard the rights and freedoms of data subjects ('limited storage');
- (f) be carried out in such a way as to ensure adequate security of personal data, including protection against unauthorised or unlawful processing, accidental loss, destruction or damage ("integrity and confidentiality"), by implementing appropriate technical or organisational measures.
The controller is responsible for compliance with the above and must be able to demonstrate such compliance ("accountability").
LEGAL RIGHTS OF NATURAL PERSONS UNDER THE GDPR
- Transparent information
All information required by the GDPR shall be provided by the Data Controller in a concise, transparent, intelligible and easily accessible form, in clear and plain language. Accordingly, the Controller shall provide information in writing, in electronic format and orally upon request.
- Access to your own data
You have the right to ask the Data Controller to confirm whether they are processing personal data concerning you and, if so, to request access to the data. The Controller shall ensure that it replies to your request without undue delay and at the latest within one month.
- Correction of inaccurate data
You have the right to have inaccurate or incomplete personal data corrected or completed by the Data Controller without undue delay upon receipt of your request.
- Right to erasure
You have the right to ask the Controller to delete your personal data, which the Controller will do without undue delay if one of the following grounds applies:
- your personal data are no longer necessary for the original purpose of the processing
- you have withdrawn your consent and there is no other legal basis for the Controller to continue to process your personal data
- the lawfulness of the processing is based on the legitimate interests of the Controller, which you claim are not overridden by legitimate grounds for the processing which override your interests, rights and freedoms
- the processing is for direct marketing purposes and you object to it
- the Controller has unlawfully processed your personal data
- your personal data must be erased in order to comply with a legal obligation under EU or Member State law applicable to the Data Controller
- where the personal data have been collected in connection with the provision of information society services referred to in Article 8(1).
Personal data may not be deleted if the processing is necessary for the following reasons:
- for the exercise of the right to freedom of expression and information
- for the purposes of complying with an obligation under Union or Member State law to which the controller is subject to process personal data or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
- on grounds of public interest in the field of public health
- for archiving purposes in the public interest, scientific and historical research purposes or statistical purposes, where such a request would be unlikely to permit or jeopardise such processing
- to bring, enforce or defend legal claims.
- The right to be forgotten
If the controller has disclosed the personal data and is required to delete it, it will take reasonable steps, including technical measures, taking into account the available technology and the cost of implementation, to inform the controllers that process the data that you have requested the deletion of the links to or copies of the personal data in question.
- Withdrawal of consent
The Data Subject may withdraw his or her consent to the processing of personal data by the Controller at any time by sending a request to. info@csokbudapest.hu to the following e-mail address, indicating the specific activity.
The withdrawal of consent shall not affect the processing already carried out by the Data Controller.
- Right to restriction of processing
You have the right to have the controller restrict processing at your request if one of the following conditions is met:
- You contest the accuracy of the personal data, in which case the restriction applies for the period of time that allows the controller to verify the accuracy of the personal data;
- the processing is unlawful and you object to the deletion of the data and instead request the restriction of their use;
- the controller no longer needs the personal data for the purposes of processing, but you require them for the establishment, exercise or defence of legal claims;
- You have objected to the processing; in this case, the restriction applies for the period until it is established whether the legitimate interests of the controller override your legitimate grounds.
If the processing is restricted on the basis of your request, in which case your personal data may only be processed with your specific consent, except for storage, or:
- To bring, enforce or defend legal claims
- To protect the rights of another person, or
- An important public interest of the Union or of a Member State.
We will inform you in advance of the lifting of any such restriction.
- The right to data portability
You have the right to receive the personal data concerning you that you have provided to a controller in a structured, commonly used, machine-readable format and the right to transmit these data to another controller without hindrance from the controller to whom you have previously provided the personal data, if:
- You have given your personal consent to the processing of your data for one or more specific purposes,
- or the prohibition on processing a special category of personal data cannot be lifted with your personal consent where EU or Member State law so provides,
- or processing is necessary for the performance of a contract to which you are a party, or for taking steps at your request prior to entering into a contract,
- Data processing is carried out by automated means
Direct data transfers between Data Controllers may take place if the technical background ensures the secure transfer of the data.
The exercise of the right to data portability must be without prejudice to the exercise of the right to erasure (forgetting).
The exercise of the right to data portability shall not apply where the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.
The right to data portability must not adversely affect the rights and freedoms of others.
- The right to protest
You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on the following data processing lawfulness provisions:
- The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller
- The processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party, except where those interests are overridden by your interests or fundamental rights and freedoms which require the protection of personal data, in particular where the Data Subject is a child of a
- If your personal data is processed for direct marketing purposes,
- Your personal data is processed for profiling purposes where it is directly related to the acquisition of a business.
If you object to the processing of your personal data for direct marketing purposes, the Data Controller may no longer process your personal data for these purposes.
The Data Controller will explicitly inform you of your rights to object when first contacting you and will display the relevant information separately from any other information, or you may exercise these rights by automated means.
- Automated decision-making on individual cases, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling, which would have legal effects concerning you or similarly significantly affect you.
You may not exercise the above rights in the following cases:
- If the decision is necessary for the conclusion or performance of a contract between you and the Data Controller
- The automated process is permitted by EU or Member State law which also lays down measures to protect your rights and freedoms and legitimate interests.
- You have also given your explicit consent to the decision based on automated processing.
If the decision based on automated processing is based on a contractual relationship between you and the Controller or on your personal consent, the Controller shall take appropriate measures to protect your rights, freedoms and legitimate interests, including at least your right to request human intervention by the Controller, to express your views and to object to the decision.
IDEADLINE FOR ACTION
The controller shall, without undue delay and in any event as soon as possible after receipt of the request. within 1 month inform you of the action taken on these requests.
If necessary, this may be extended by 2 months. The data controller shall inform the applicant of the extension of the time limit, stating the reasons for the delay, within within 1 month will inform you.
If the controller does not act on your request, inform you of the reasons for the non-action without delay and at the latest within one month of receipt of the request, and that you can lodge a complaint with a supervisory authority and exercise your right to judicial redress.
ASECURITY OF DATA PROCESSING
The controller and the processor shall implement appropriate technical and organisational measures, taking into account the state of the art and the cost of implementation, the nature, scope, context and purposes of the processing and the varying degrees of probability and severity of the risk to the rights and freedoms of natural persons, in order to ensure a level of data security appropriate to the level of risk, including, where appropriate:
- a) the pseudonymisation and encryption of personal data;
- (b) the continued confidentiality, integrity, availability and resilience of the systems and services used to process personal data;
- (c) in the event of a physical or technical incident, the ability to restore access to and availability of personal data in a timely manner;
- (d) a procedure for the regular testing, evaluation and assessment of the effectiveness of the technical and organisational measures taken to ensure the security of processing.

AINFORMING THE DATA SUBJECT ABOUT THE PERSONAL DATA BREACH
If the personal data breach is likely to result in a high risk to the rights and freedoms of natural persons, the controller shall inform you of the personal data breach without undue delay.
In the information provided to you in a clear and understandable way be described
the nature of the data breach and the name and contact details of the Data Protection Officer or other contact person who can provide further information;
explain the likely consequences of the data breach;
describe the measures taken or envisaged by the controller to remedy the personal data breach, including, where appropriate, measures to mitigate any adverse consequences of the personal data breach.
You do not need to be informed if any of the following conditions are met:
the controller has implemented appropriate technical and organisational security measures, and these measures have been applied to the data affected by the personal data breach, in particular measures such as the use of encryption, which are not available to persons who are not authorised to access personal data make the data uninterpretable;
the controller has taken further measures following the personal data breach which. ensure that the high risk to the rights and freedoms of the data subject is no longer likely to materialise;

AREPORTING A DATA BREACH TO THE SUPERVISORY AUTHORITY
The data protection incident shall be notified by the controller to the supervisory authority competent under Article 55 without undue delay and, where possible, no later than 72 hours after the data protection incident has come to its attention, unless the data protection incident is unlikely to pose a risk to the rights and freedoms of natural persons. If the notification is not made within 72 hours, it shall be accompanied by the reasons justifying the delay.

EXERCISE OF THE RIGHT TO AN EFFECTIVE JUDICIAL REMEDY AGAINST A CONTROLLER OR PROCESSOR:
If you consider that we have not acted properly in the processing of your personal data in violation of your rights under the GDPR, you have the right to judicial remedy.
Proceedings against the Controller or the Processor shall be brought before the courts of the EU Member State where the Controller or the Processor is established. Such proceedings may also be brought before the courts of the EU Member State where you are located.
In addition to the provisions of the GDPR, the court proceedings shall be governed by the provisions of Act V of 2013 on the Civil Code, Book Two, Part Three, Title XII (§§ 2:51-2:54) and other legal provisions applicable to court proceedings.

Duration of data processing, deadline for data deletion: a contract has been created in the system of the Data Controller by using the service, so the deadline for deletion of personal data is regulated by Article 169 (2) of Act C of 2000 on Accounting, which requires that the data be kept for 8 years.
The accounting documents (including general ledger accounts, analytical or detailed records) directly and indirectly supporting the accounting accounts must be kept for at least 8 years in a legible form, retrievable by reference to the accounting records.
The catering establishment is legally obliged to report the number of guests to the local government and to record it in the NTAK system, so this data must be kept for 6 years from the date of registration.
If you specifically request the retention of your data in order to simplify future bookings, please make this clear when selecting your data management options. In this case, the legal basis for processing will be your personal consent. You may withdraw your consent at any time, but such withdrawal will not affect the lawful processing that preceded it. In this case, your personal data will be kept for 8 years from the date of your last reservation.

Data subjects: guests can give their opinion on the restaurant's services as part of the quality assurance process applied by the Data Controller, using an electronic and paper-based guest questionnaire and a rating system.
The data are not mandatory, they are only used to investigate specific complaints and to ensure a response.
The Data Controller may also use the opinions obtained in this way and any related data that cannot be traced back to the guest in question for statistical purposes.
If you communicate your opinion to the Data Controller anonymously, no personal data will be processed.
Duration of processing, time limit for deletion of data: personal data received in this form of processing will be deleted after one year from the end of the year in which the request, question or complaint was answered. The e-mail address and username provided for the use of the rating system will be deleted immediately upon your request to that effect.

The service provider may process personal data that are technically necessary for the provision of the service. The provider must, other things being equal, choose and in any event operate the means used in the provision of the information society service in such a way that personal data are processed only to the extent strictly necessary for the provision of the service and for the fulfilment of the other purposes laid down in this Act, but even then only to the extent and for the duration necessary.
Please note that
the processing is based on your consent and necessary for compliance with a legal obligation to which the controller is subject, and therefore obliged provide the personal data to enable the Data Controller to fulfil its obligations.
Failure to provide the data or withdrawal of consent with the consequences to answer the Controller's questions, requests, complaints and to comply with its legal obligations. Withdrawal of consent shall not affect the lawful processing that preceded it.
- CAMERA SYSTEM
The restaurant is equipped with cameras for the safety of guests and their property. The presence of cameras is indicated by a pictogram and a warning text.
The purpose of CCTV surveillance is to protect the property and personal values of Guests, given that there is no other way to detect the infringement, to catch the perpetrator in the act, to prevent infringing acts or to prove them by any other method.
Detailed information on data management in connection with the camera system is available from the staff on site. Specific information about the area of operation of the camera system, the location of the specific cameras, the subject of the surveillance, the purpose of the operation, the technical conditions of the surveillance and the storage period of the recorded data can be found in the separate data management information attached as an annex to this privacy statement.
